PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.194 of 2023 on the file of the Respondent Police.

ORDER : The Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Section 4(1)(aaa) of the Tamil Nadu Prohibition Act, 1937 in Crime No.194 of 2023 on the file of the respondent police, seeks anticipatory bail.

2.The case of the prosecution is that on 02.10.2023, when the police party 1/3

conducted inspection, they found that the first accused illegally stored 912 bottles of alcohol in a godown and the petitioner herein also involved in the said crime. Hence, the case.

3.The learned counsel appearing for the petitioners would submit that the petitioner is an innocent and he has not committed any offence as alleged by the prosecution. Hence, he seeks anticipatory bail. 4.The learned Additional Public Prosecutor appearing for the respondent police would submit that the first accused found in illegal possession of 912 bottles of alcohol and based on his confession the present case came to be registered. The investigation in this case is not yet completed. Therefore, he strongly objected to grant anticipatory bail to the petitioner.

5.Considering the facts and circumstances of the case and also considering the nature of offence committed by the accused, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, this criminal original petition is dismissed.
