O R D E R

This criminal original petition had been filed seeking direction to the Respondent No.1 to strictly instruct the Respondent No.2 Not to Harass the Petitioner.

2.The learned Counsel appearing for the Petitioner submits that the Petitioner as well as the third Respondent were partners in business. They jointly purchased a car. After some years, they wanted to sell it. They could not get a fair price. Therefore, the third Respondent agreed to take the car. Subsequently, he approached the Petitioner to take back the car and pay him the money for his share of the car, for which, the Petitioner did not agree as he already stated to the Petitioner that he/third Respondent will take the car and pay the amount to the Petitioner after selling the car. But, he could not sell it. Therefore, he is alleged to have approached the second Respondent and filed a complaint against the Petitioner. Based on the complaint of the third Respondent, the second Respondent had been summoning the Petitioner at odd hours and causing harassment to the Petitioner. Hence, this petition had been filed.

3.The learned Government Advocate (Crl.Side) submits that based on the 2/4

complaint lodged by the third Respondent, CSR No.163 of 2022 was registered. Both parties were summoned, they appeared for enquiry. After enquiry, both parties agreed to proceed the case through civil Court. Therefore, the complaint was closed.
