ORDER

This writ petition has been filed seeking for issuance of the writ of mandamus to direct the respondents 1 and 2 to initiate appropriate action against the respondents 3 to 8 based on the complaint dated 11.09.2024 given by the petitioner.

2. Mr.A.Thiruvadikumar, learned Additional Public Prosecutor, accepts notice on behalf of the respondents 1 and 2. By consent, this writ petition is taken up for final disposal at the admission stage itself.

3. It is the case of the petitioner that the subject property originally belonged to one Muniyammal, who died intestate without any issues. Knowing the same, the respondents 3 to 8 entered into a conspiracy to create the forged document with an intention to grab the property of said Muniyammal and committed the act of forgery to register the document. According to the petitioner, the said Muniyammal has no issues and the property was allotted to her in the year 1970 under the beneficiary scheme 2/5

by the revenue department. In this regard, the petitioner sent a complaint on 11.09.2024 to the Anti-Land Grabbing Cell. On the face of complaint, though it is disclosed cognizable offence is made out, enquiry has not been conducted so far. Hence, the above petition.

4. The learned Additional Public Prosecutor would submit that the petitioner's complaint dated 11.09.2024 had been sent to the Anti Land Grabbing Cell, which is now abolished. The complaint with regard to land grab is now being investigated by the Inspector of Police, District Crime Branch II. A copy of the complaint to the District Crime Branch II, who shall take appropriate action in this regard, has been produced before this Court.

In view of the above, the petitioner is directed to appear before the Inspector of Police, District Crime Branch II, Dindigul, within fifteen days from the date of receipt of a copy of this order and submit a copy of the above complaint. On receipt of the same, the Inspector of Police, District Crime Branch II, Dindigul, shall take action on merits and in accordance with law. Since the offence is serious in nature, the Deputy Superintendent of Police/first respondent to monitor the said case. 3/5

6. With the above direction, this Writ Petition is disposed of. No costs.
