P RAYER : Petition filed under Article 226 of the Constitution of India, to issue a Writ of Certiorarified Mandamus, calling for the records pertaining to the impugned order in Letter No. H5/03535/2023 dated 22.12.2023 passed by the 4th respondent and quash the same as illegal, arbitrary and consequently directing the 3rd and 4th respondents to carry out the amendment with regard to the name of the petitioner's great grandfather as Chinnakaruppan @ Karuppan instead of Sannasi in the death certificate of her grandfather Late. Velu vide registration No. 115/1194/67/00019 dated 12.09.1994 issued by the 2nd respondent herein, based on the representation of the petitioner's deceased father, dated 30.06.2021 and 18.05.2023 made to the 2nd respondent. ORDER

This writ petition has been filed challenging the order passed by the 4th respondent dated 22.12.2023 thereby rejected the request made by the petitioner to change her great grandfather's name as Chinnakaruppan 2/6

@ Karuppan instead of Sannasi, in the death certificate of her grandfather dated 12.09.1994 issued by the second respondent.

2. By consent of both parties, this writ petition is taken up for final disposal at the stage of admission itself.

3. Heard the learned counsel on either side and perused the materials placed before this Court.

4. The petitioner is the daughter of V.Sudalaikkan and her grandfather's name is S.Velu and he died on 09.09.1994 and his death was registered on 12.09.1994. In his death certificate, her great grandfather's name is mentioned as Sannasi. After a period of 30 years, the petitioner, being granddaughter of the said Velu submitted a representation to change the name of her great grandfather's name as Chinnakaruppan @ Karuppan instead of Sannasi.

5. In the earlier round, the petitioner's father made an application before the second respondent and the same was not considered. As such, 3/6

he approached this Court in WP(MD)No.12598 of 2023 and this Court directed the respondents therein to consider his representation and pass orders. However, the petitioner's father failed to produce any records to show that his grandfather's name is Chinnakaruppan @ Karuppan. Therefore, the request was rejected by order dated 22.12.2023.

6. Since the petitioner's father is bedridden, the petitioner being his daughter, filed this writ petition challenging the order passed by the fourth respondent. Even today, the petitioner is not able to produce any document to show that her great grandfather's name is Chinnakaruppan @ Karuppan. That apart, the petitioner's grandfather died on 09.09.1994. However, the petitioner's father approached the respondents only in the year 2021 for change of his grandfather's name as Chinnakaruppan @ Karuppan instead of Sannasi. However, he did not produce any document to show that his grandfather's name as Chinnakaruppan @ Karuppan.

7. In view of the above, the fourth respondent rightly rejected the application submitted by the petitioner's father. This Court finds no 4/6

infirmity or illegality in the order passed by the fourth respondent. This writ petition is dismissed accordingly. No costs. 11.11.2024 Index : Yes / No NCC : Yes / No Sm 5/6
