The order of the learned Single Judge directing the respondents to follow G.O. Ms. No. 340, dated 26.08.2010, and to provide fitment as per the said Government Order, which was issued to rectify the anomaly in pay fixation, is being challenged in this writ appeal.
2. This Court, upon perusing the Government Order relied upon by the learned Single Judge, finds that the Government Order was issued taking into account the anomaly in pay fixation between persons who were appointed after 01.06.2009 and those who were selected but not appointed as of 01.06.2009. The order of the learned Single Judge is in consonance
with the letter and spirit of G.O. Ms. No. 340, which was intended to rectify the anomaly in pay fixation.
3. The recommendation of the One-Man Commission regarding the fixation of pay for Junior Assistants and Agricultural Officers has been taken into consideration in the said Government Order. There can be no other alternative except to implement the Government Order in its letter and spirit.
4. Hence, the Writ Appeal stands dismissed. No costs. Consequently, connected miscellaneous Petition stands dismissed. [G.J., J.] & [R.P., J.] 24.04.2025 NCC : Yes / No Index : Yes / No KSA
