ORDER

This Writ Petition has been filed to direct the respondents to issue Non Traceable Certificate based upon the Representation of the petitioner dated 01.07.2024.

2. The petitioner had sent a representation on 01.07.2024 stating the original registered document in Doc.No.1480/1978 has been found missing. Though C.S.R.No.227/2024 assigned on the petitioner's complaint, no action has been taken. Hence, the above Petition.

3. The learned Additional Public Prosecutor submitted that on the petitioner's complaint C.S.R.No.227/2024 assigned. The contention of the petitioner is that the petitioner had come to Seithur bus stand on three days between 03.05.2024 and 05.05.2024 and on which date the document said to have been lost. On the complaint of the petitioner, CDR details were called for and found that the petitioner, only one day come to the Seithur bus stand and not for three days. Further, the complaint itself lodged after a period of more than 18 days. Hence, it cause some doubt. The petitioner might have lost the document elsewhere and fixing the jurisdiction of the second respondent. For that reason, the petitioner was advised to approach the South Police Station, where the petitioner resides.

4. The learned Additional Public Prosecutor fairly submitted that if the petitioner appears for enquiry, further enquiry would be made and the C.S.R.No.227/2024 would be taken into consideration.

Considering the abovesaid submission and materials placed, the second respondent police is directed to conduct enquiry and issue Non-traceable Certificate to the writ petitioner, after ensuring that the said document has not been deposited for any purpose and after following the circular issued by the Director General of Police, in Rc.No. 2029209/General.1 (1)/2022, dated 01.04.2022, within a period of three months from the date of receipt of a copy of this order.

6. With the above direction, the Writ Petition stands disposed of. No costs.
