ORDER : The Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Section 379 IPC and Section 21(1) of the Mines and Minerals (Development & Regulation)Act, 1957 in Crime No.325 of 2023 on the file of the respondent police, seeks anticipatory bail. 1/3

2.The case of the prosecution is that on 08.10.2023, the petitioner illegally transported 1⁄4 unit of river sand in his bullock cart. On seeing the police party, the petitioner escaped from the place of occurrence. Hence, the case. 3.The learned counsel appearing for the petitioners would submit that the petitioner is an innocent and he has not committed any offence as alleged by the prosecution. Hence, he seeks anticipatory bail. 4.The learned Government Advocate(Crl.side) appearing for the respondent police would submit that the petitioner involved in river sand theft and he is having two similar previous cases. Therefore, she strongly objected to grant anticipatory bail to the petitioner.

5.Considering the nature of allegations levelled as against the petitioner and also considering the bad antecedents of the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, this criminal original petition is dismissed.
