Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying for issuance of Writ of Mandamus, directing the respondent to pay a sum of Rs.4,95,483/- to the petitioner along with interest for the electrical works done by the petitioner for the respondent department for the period 2010-12 pursuant to the proceedings addressed to the 2nd respondent in Letter No.9030/B4/B42/2015-2 dated 04.09.2015.

ORDER

This writ petition has been filed for the following relief : "directing the respondent to pay a sum of Rs.4,95,483/- to the petitioner along with interest for the electrical works done by the petitioner for the respondent department for the period 2010-12 pursuant to the proceedings addressed to the 2nd respondent in Letter No.9030/B4/B42/2015-2 dated 04.09.2015."

It is the case of the petitioner that during the period from 2010-12, he was engaged by the Assistant Executive Engineer (C & I), TANGEDCO, Nagercoil and Assistant Executive Engineer (Distribution) South and North, Nagercoil to do various electrical works within their circle. For the works done by the petitioner, the respondents have to pay a total sum of Rs.4,95,483/-. In this regard, the petitioner submitted a representation on 19.12.2014 to the Secretary of the Electricity Department. A legal notice has also been sent to the respondents on

18.03.2019 to pay the said amount. Since the respondents have not taken any action, the petitioner is before this Court.

3. Heard the learned counsel on either side.

4. A perusal of the letter, dated 18.08.2016 issued by the Executive Engineer, Kaniyakumari to Mr.S.Nagarajan clearly establishes that the petitioner has executed the work. The petitioner is directed to produce necessary proof to show that he had undertaken the work and completed the same. On such production, the 2nd respondent shall consider the same and make payment to the petitioner within a period of three (3) months from the date of receipt of copy of this order.

5. With the above directions, this Writ Petition stands allowed. No costs.
