ORDER : The Court made the following order :- The petitioner, who is arrayed as accused, was arrested and remanded to Judicial Custody on 28.07.2023 for the offence punishable under Sections 294(b), 302 and 506(ii) IPC in Crime No.28 of 2018 on the file of the respondent police seeks bail. 1/3

2. The case of the prosecution is that due to the non-appearance of the petitioner, Non Bailable Warrant was issued on 08.04.2023 and based on that, the petitioner herein was arrested and he is in jail from 28.07.2023.

3. The learned counsel appearing for the petitioner submitted that due to ill-health the petitioner has not appeared before the trial Court and he is in judicial custody from 28.07.2023 and seeks bail.

4. The learned Additional Public Prosecutor appearing for the respondent would submit due to the non-appearance of the petitioner, Non Bailable Warrant was issued on 08.04.2023 and based on that the petitioner herein was arrested and remanded to judicial custody and hence, he strongly objected to grant bail to the petitioner.

5. On perusal of the documents it is seen that PW.1 to PW.7 were examined and the case is pending for examination of remaining witnesses. In such circumstances, I do not find any ground to grant bail to the petitioner at this stage.
