ORDER : The Court made the following order :- The petitioner / Accused herein, who apprehends arrest at the hands of the respondent police for the alleged offence under Sections 379 of IPC and Section 511 of 1/3
Mines and Minerals (Development and Regulation) Act, 1957, in Crime No.83 of 2023, on the file of the respondent police, seeks bail.
2. The case of the prosecution is that on 21.07.2023, on receiving secret information, the respondent police went to the occurrence place and made an inspection and found the petitioner illegally mining sand in a Vari by using a JCB vehicle. Hence the complaint.
3. Learned Additional Public Prosecutor submitted that the earlier application was dismissed on the ground that the petitioner is having previous case in similar nature.
4. Considering the facts and circumstances of this case and also the submissions of the learned Additional Public Prosecutor, I find no reason to grant relief to the petitioner. There is no change of circumstances.
