PRAYER :- For Bail in Crime No.91/2022 on the file of the Respondent Police.

ORDER : The Court made the following order :- The petitioner who was arrested and remanded to judicial custody on 13.10.2022 for the offences punishable under Sections 397 @ 341, 392, 397 and 120(b) of IPC in Crime No. 91 of 2022 on the file of the respondent police, seeks bail.

2. The case of the defacto complainant viz., Vikneswaran is that on 06.10.2022, at about 04.30 p.m, when he was proceeding towards Karaikudi with cash of Rs.11 lakh in a TATA Ace goods vehicle, the accused persons, who came in a Swift Car, are said to have waylaid his vehicle and taken away the said amount by attacking him with weapons. Hence, the complaint.

3. The learned counsel appearing for the petitioner would submit that the petitioner is an innocent person and he has been falsely implicated in this case. He would submit that this is the second bail petition. Earlier petition filed by the petitioner in Crl.OP(MD)No.20574 of 2022 was dismissed by this Court, on 21.11.2022. He would submit that the petitioner is in judicial custody from 13.10.2022. Hence, he prays to grant bail to the petitioner.

4. The learned Additional Public Prosecutor appearing for the respondent would submit that the petitioner is having 8 previous cases. Out of which, 3 cases are similar in nature. Hence, he strongly opposed to grant bail to the petitioner. 5.Considering the facts and circumstances of the case and also considering the antecedent of the petitioner, this Court is not inclined to grant bail to the petitioner.
