ORDER

This Criminal Original Petition has been filed seeking a direction to transfer the investigation from the 3rd respondent in Crime No.260 of 2019 dated 28/08/2019 to any other competent authority and to file the final report as fixed by this Honourable Court

2. The learned counsel for the petitioner would submit that though the petitioner was brutally assaulted and attempt was made on her, the third respondent has registered a case only for offences under Sections 341,294(b),323, 506(i) of IPC and Section 4 of TNPHW Act. Hence he seeks to transfer the investigation from the file of the third respondent to any other investigating agency.

3. The learned Government Advocate(Crl.Side) would submit that on the complaint given by the petitioner against her mother-in-law a case has been registered for for offences under Sections 341,294(b),323, 506(i) of IPC and Section 4 of TNPHW Act. Crl.O.P.(MD)No.18964 of 2019 into consideration that the case arising out of matrimonial dispute and the third respondent is conducting investigation in a proper manner . However, inorder to circumvent the grievance of the petitioner, direction may be issued to the second respondent monitor the investigation done by the third respondent.

4. Hence, this Criminal Original Petition is closed. Further the second respondent is directed to monitor the investigation done by the third respondent.
