PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.36/2023 on the file of the Respondent Police. ORDER : The Court made the following order :- The petitioner/Accused, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 406, 420 and 120B IPC in Crime No.36 of 2023 on the file of the respondent police, seeks anticipatory bail.
2. The case of the prosecution is that the petitioner was the President of Anaithu Vanikar Nala Sangam, Thoothukudi District. While so, he misappropriated the chit amount run by the said Sangam. Hence, the case. 3.The learned counsel appearing for the petitioner would submit that the petitioner is the innocent person and he has not committed any offence as alleged by the prosecution. Hence, he prays for anticipatory bail to the petitioner. 4.The learned Government Advocate (criminal side) appearing for the respondent police would submit that the petitioner has misappropriated the funds of the Sangam and he has not disbursed the scheme amount to the members. There are more than 45 persons are cheated and the total cheated amount comes around Rs.1,53,96,000/-. Hence, he strongly opposed to grant anticipatory bail to the petitioner.

5.The learned counsels appearing for the intervenors have also strongly opposed to grant anticipatory bail to the petitioner. 6.Heard both sides and perused the materials available on the record.
7. Considering the facts and circumstances of the case and also considering the nature of allegation and considering the fact that the cheated amount is very high, this Court is not inclined to grant anticipatory bail to the petitioner. Hence, this Criminal Original Petition is dismissed.
