For R - 1 : Mr.B.Thanga Aravindh, Government Advocate (Crl.Side) PRAYER :- To call for the records of the anticipatory bail order passed in Crl.MP.No.1435 of 2022, dated 14.06.2022 on the file of Principal District and Sessions Court, Virudhunagar District Court, Srivilliputhur and set aside the same.

ORDER : The Court made the following order :- This petition has been filed to cancel the anticipatory bail granted to the respondents 2 and 3 in Crl.MP.No.1435 of 2022, dated 14.06.2022 on the file of Principal District and Sessions Court, Virudhunagar District Court, Srivilliputhur, on the ground that the respondents 2 and 3 suppressed the fact before the court below and obtained anticipatory bail.

2.The petitioner sustained grave injuries on her head and was admitted in the hospital as an inpatient till 26.02.2022, whereas the respondents 2 and 3 misrepresented the court below, as if the defacto complainant was discharged from the hospital and https://www.mhc.tn.gov.in/judis 1/2

CRL OP(MD). No.21477 of 2022 obtained anticipatory bail.

3.Per contra, the learned Government Advocate (Criminal Side) appearing for the first respondent would submit that the entire investigation has been completed by the first respondent in Crime No.97 of 2022 and also filed a final report before the concerned court.

4.Taking into consideration the facts and circumstances of the case, this Court finds no ground to cancel the anticipatory bail granted to the respondents 2 and 3 herein.

5.Accordingly, this Criminal Original Petition is dismissed.
