Respondents PRAYER: Petition filed under Article 226 of the Constitution of India to issue a Writ of Certiorarified Mandamus, to call for the records of the impugned order passed by the second respondent in No.21244/Thaku2/2019, dated 03.12.2019 and quash the same and consequently, directing the respondent to grant parole to the petitioner's son namely Kalidass (Convict Prisoner No.5823) S/o.Sendurpandi, aged about 34 years who are undergoing sentence as life convict at present in Central Prison, Madurai, for the period of 15 days for the purpose of arranging medical expenses to the petitioner's wife and to assist the petitioner's wife at the time of taking treatment based on the representation dated 30.09.2019 .

ORDER

The petitioner is a life convict undergoing his sentence in Madurai Central Prison. He earlier applied for ordinary leave. The same was rejected vide order dated 03.12.2019 citing his involvement in a petty case. The said case has since got concluded.

2. The learned Government Advocate (Crl.side) states that the petitioner is entitled to six days emergency leave.

3. In this view of the matter, the impugned order is quashed and the second respondent is directed to issue proceedings permitting the petitioner to go on six days emergency leave. 4.The writ petition is allowed on these terms.
