PRAYER: Writ Petition filed under Article 226 of Constitution of India, to issue a Writ of Certiorarified Mandamus, to call for the records pertaining to the impugned order in Na.Ka.No.225/2019 dated 18-11-2019 on the file of the respondent 5 and quash the same as illegal and consequently directing the Respondents No.1 to 2 to accommodate the petitioner in the entry level post such as Junior assistant or Tax Collector in Theni District within the time frame stipulated by this Honourable Court.

Heard both sides.

2.When the matter is taken up for hearing today, the learned Additional Government Pleader appearing for the respondents 1 to 4, by referring to paragraph 8 of the counter affidavit filed by the fifth respondent, would submit that the post sought for by the petitioner is promotional post and that, for in-service candidates, as per G.O.Ms.No. 150, Municipal Administration and Water Supply Department, dated 19.08.1998, only 20% vacancies are reserved. He further submitted that as and when the petitioner becomes eligible, his case will be considered 2/5

for promotion. He also further submitted that the petitioner is presently at serial No.9 in the seniority list.

3.After hearing the submissions, this Court is of the view that there is no necessity for any further adjudication. Hence, recording the submissions of learned Additional Government Pleader, this Writ Petition is closed. There shall be no order as to costs. Consequently, connected Miscellaneous Petition is closed.
