PRAYER:Writ Petition is filed under Article 226 of the Constitution of India, to issue a writ of Mandamus, directing the 1st respondent to sanction the enhancement of 75% of subsistence allowance to the petitioner right from the date of expiry of six months of suspension as per specific provision contain under Rule 53(1) (a)(i) of Fundamental Rules by considering the petitioner's representation dated 12.01.2024 and the proceeding of the 2nd Respondent dated 29.01.2024.

ORDER
The instant writ petition has been filed by a suspended employee seeking a mandamus for enhancement of subsistence allowance from 50% to 75%.
2. According to the learned Counsel appearing for the writ petitioner, the request of the petitioner has been forwarded by the 2nd respondent to the 1st respondent by his proceedings dated 29.01.2024. So far no orders have been passed by the 1st respondent.
3. Considering the above said facts, this Court directs the first respondent to consider the request of the petitioner dated 12.01.2024 and the proceedings of the 2nd Respondent dated 29.01.2024 and pass orders on merits and in accordance with law within a period of twelve (12) weeks from the date of receipt of a copy of this order.

4. With the above said observations, this writ petition is disposed of. No costs.
