PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the 2nd respondent for not to interfere into the civil dispute pending between the petitioner and the 3rd respondent in A.S.(MD) No.189 of 2023 before this Court by considering the petitioner's representation dated 11.10.2023. O R D E R

This writ petition has been filed seeking issuance of Writ of Mandamus, directing the 2nd respondent for not to interfere into the civil dispute pending between the petitioner and the 3rd respondent in A.S. (MD) No.189 of 2023 before this Court by considering the petitioner's representation dated 11.10.2023.

2.When the matter is taken up for hearing, the learned Additional Public Prosecutor would submit that on the basis of the complaint given by the defacto complainant case in Crime No.499 of 2021 was registered against this petitioner and others. It is a issue between the parties over partition of the family property. After investigation the name of this petitioner and Vanitha have been deleted from the array of accused. Hence, as on date, no complaint against the petitioner. Only this petitioner sent the representation on the very same ground. 3.Since no complaint is pending against the petitioner as on the date, nothings survives for further consideration in this petition. 2/4
