ORDER : The Court made the following order :- The petitioner / Accused No.1, who was arrested and remanded to judicial custody on 04.04.2024 for the alleged offences under Sections 8(c) r/w. 20(b)(ii)(C), 23(c), 28 and 29 of NDPS Act, 1985, in C.C. No.14/2021 on the file of the II Additional Special Court for NDPS Act Cases, Madurai, seeks bail.

2. Heard the learned counsel on either side and perused the material records of the case.

3. It is brought to the notice of this Court that there are 4 accused persons in this case and the petitioner has been arrayed as A1. A3 and A4 underwent trial in C.C. No. 56 of 2019 and they were convicted and sentenced by the learned Trial Court. The case against the petitioner and A2 was split up and it is now pending in C.C. No. 14 of 2021 and the trial is yet to commence.

4. The respondent has filed objections stating that an absconding charge sheet was filed in the year 2019 and ultimately, the petitioner was able to be produced before the Court only on 04.04.2024.

5. This Court is not inclined to consider the bail application at this stage. There must be some progress in the trial and thereafter, this Court will consider any bail application.
