Heard Mr.R.Saravanan, learned counsel appearing for the petitioner and Mrs.J.Padmavathi Devi, learned Special Government Pleader appearing for the respondents.
2.This Writ petition has been filed challenging the impugned order passed by the first respondent dated 20.11.2019 in ThiPaPee6/10737/2019 and further to direct the second respondent to issue No objection certificate for the land bearing S.No.282/3E2A to an extent of 2.30 Ares and patta No.18258 for the punja land situated at Kattuparamakudi, Paramakudi.
3.According to the petitioner, he is having a land in Survey No.282/3E2A to an extent of 2.30 Ares and also having patta No.18258 for punja land situated at Kattuparamakudi, Paramakudi. Since the 1/3
petitioner has made a plan to construct a house in the above said patta land, he applied for No Objection Certificate to the first respondent on 21.08.2019 along with necessary documents. In the mean time, the petitioner had moved an application for availing housing loan from the Life Insurance Corporation. While so, the petitioner was intimated by the Assistant Agriculture Officer, Paramakudi, with regard to the verification of the land on 06.09.2019. After completion of the verification, the petitioner's husband requested the Assistant Agriculture Officer to send the report to the first respondent at the earliest. So far, no progress from the first respondent. Therefore, the petitioner sent a detailed representation to the first respondent in this regard. Since no steps have been taken, the petitioner is before this Court. 4.
When the matter is taken up for hearing, the learned Special Government Pleader appearing for the respondents, on instructions submitted that the first respondent has already submitted the report to the second respondent and in this regard, she produced a copy of the report before this Court.
5.Admittedly, the petitioner has not even applied before the second respondent for issuance of No Objection Certificate. Hence, this Court directs the petitioner to apply before the second respondent for issuance of No Objection Certificate within a period of one week from the date of receipt of a copy of this order. On receipt of such application, the second respondent is directed to consider the same and issue appropriate certificate, if otherwise in order, within a period of two weeks thereafter. 6.With the above directions, this Writ Petition stands disposed of. No costs.
