O R D E R

The petitioner, who apprehends arrest at the hands of the respondent Police for the offences punishable under Sections 8(C) r/w 20(b)(ii)B and 29(1) of NDPS Act in Crime No.80 of 2022 on the file of the respondent Police, seeks anticipatory bail. 2.The case of the prosecution, as per the de-facto complainant, is that the petitioner along with other accused was found in possession of 10 kg of kanja and seeing the police, they ran away from the scene of occurrence. Hence, the complaint. 3.The learned Counsel for the petitioner would submit that the petitioner is an innocent and he has been falsely roped in this case based on the confession of the co-accused.

4.The learned Additional Public Prosecutor would submit that the petitioner is a habitual offender, against whom, there are four previous cases of similar nature registered in Cr.No.912 of 2020, under Sections 20(b)ii(b) of NPDS Act, in Cr.No.1062 of 2020 under Sections 20(b)ii(b) and 29(1) of NPDS Act, in Cr.No.97 of 2021 under Sections 8(c) r/w 20(b)ii(b), 29(1) and 25 of NPDS Act and in Cr.No.570 of 2021 under Sections 8(c) r/w 20(b)ii(b) and 29(1) of NPDS Act on the file of the respondent Police. https://www.mhc.tn.gov.in/judis 1/2

CRL.O.P(MD)No.21361 of 2022 5.Taking into consideration the amount involved and also the habituality of the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner. Hence, this petition is dismissed.
