PRAYER :- For Bail in Crime No.29 of 2022 on the file of the Respondent Police.

ORDER : The Court made the following order :- The petitioner/Accused No.1 herein, who was arrested on 20.10.2022 for the alleged offence under Sections 417, 468, 471, 420, 120(b), 294(b) & 506(i) of IPC, in Crime No.29 of 2022, on the file of the respondent police, seeks bail.

2.The case of the prosecution is that the petitioner herein is running an Institute called Railway Technical Education. The petitioner and the other accused received a sum of Rs.36,84,000/- from the defacto complainant by giving a false promise that they will get job in Railway Department and issued a fake appointment order. Hence, the complaint.

3.The learned counsel for the petitioner submitted that the petitioner is an innocent person and she has not committed any offence as alleged by the prosecution. He would further submit that there was money transaction between the petitioner and the defacto https://www.mhc.tn.gov.in/judis 1/2

CRL OP(MD). No.21371 of 2022 complainant. Due to that motive, false case has been foisted against the petitioner and the petitioner. Further, he is in custody for more than 40 days. Hence, he prays for grant of bail to the petitioner.

4.The learned Additional Public Prosecutor submitted that it is a case of job rocketing. There are 3 victims. The amount involved in this case is Rs.36 lakhs. The petitioner is having 2 previous cases similar in nature. Hence, he opposed to grant bail to the petitioner.

5.Since the petitioner is having previous cases similar in nature and the money involved in this case was not recovered sofar, he is not entitled for bail, if released, he may abscond and tamper evidence.
