ORDER

This Criminal Original Petition has been filed, invoking Section 482 Cr.P.C., seeking orders to direct the respondent police to complete 1/4

the Investigation in Crime No. 10 of 2015 and file a final report before the learned Judicial Magistrate III, Nagercoil, by following due process of law within time stipulated by this Court.

2. Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondent.

3. The learned Additional Public Prosecutor would submit that the above said case was closed as mistake of fact on 12.01.2015 itself. RCS notice has been served upon the petitioner.

4. The learned counsel for the petitioner would submit that no notice was received by the petitioner.

5. It appear that no record is available whether the RCS notice has been served upon the petitioner or not. The entire CD file has been destroyed as per the direction of Inspector General of Police, South Zone. Let the fresh notice be served upon the petitioner, so that he can workout his remedy through appropriate proceedings. 2/4

6. With the above said liberty an direction, this Criminal Original Petition is disposed of.
