ORDER : The Court made the following order :- The petitioner/accused, who arrayed as accused was arrested and remanded to judicial custody on 22.07.2023 for the offences punishable under Sections 8(c) r/w. 1/3
20(b)(ii)(c) and 25 of NDPS Act, 1985 in Crime No. 459 of 2023, on the file of the respondent police seeks bail.
2. The case of the prosecution is that when the respondent police conducted a vehicle check up on 14.06.2023, the petitioner herein and other accused have illegally found in possession of 409 kgs of Ganja. Hence, the case.
3. The learned counsel appearing for the petitioner submitted that based on the confession of co-accused only the petitioner herein is arrayed as accused and he has also not present in the scene of occurrence. He would further submit that no contraband has been recovered from the petitioner and he is only running a jewellery shop and he is in judicial custody from 14.06.2023 and seeks bail.

The learned Additional Public Prosecutor appearing for the respondent produced the call details and submitted that A3 is main accused and he has arranged A1 and A2 for transportation of Narcotics drugs, for which the petitioner herein has conducted A3 over phone for more 146 times and hence, he strongly opposed to grant bail to the petitioner.
5. Considering the serious nature of allegations made against the petitioner and also considering the fact that the contraband recovered is commercial quantity, this Court is not inclined to grant bail to the petitioner. 2/3
