ORDER

The present contempt petition has been filed alleging violation of the order passed by this Court, dated 04.08.2022 made in W.P(MD) No. 17380 of 2022. In the said writ petition, this Court has passed the following orders:

(i) The petitioner was directed to deposit a sum of Rs.30,854/- (Rupees Thirty Thousand Eight Hundred and Fifty Four only) as the alleged due amount towards the unpaid loan amount; (ii) On such deposit, the contemnor/third respondent was directed to release the original title deeds; and (iii) The contemnor/third respondent was directed to conduct an enquiry with regard to the claim of the petitioner whether he had already repaid the said loan amount or not.

2. The first two parts of the orders have been complied with. As far as the third part of the order is concerned, the third respondent in the writ petition has conducted an enquiry and he has submitted a report to the fourth respondent on 12.12.2023 to the effect that excess amount of 2/5

Rs.30,000/- (Rupees Thirty Thousand only) has been recovered from the writ petitioner. The contemnor/third respondent has forwarded the said report to the fourth respondent in the writ petition. In turn, the fourth respondent has addressed a communication to the second respondent in the writ petition on 14.12.2022 requesting the second respondent to refund the amount that was recovered from the writ petitioner. So far, the second respondent has not yet disbursed the said excess amount that was recovered from the writ petitioner.

3. Considering the above said facts, this Contempt Petition stands closed, with a direction to the second respondent in the writ petition to disburse the amount as per the report of the contemnor/third respondent dated 12.12.2023 and the report of the fourth respondent to the second respondent dated 14.12.2022 within a period of four weeks from the date of receipt of a copy of this order.
