PRAYER : Criminal Original Petition is filed under Section 482 of Cr.P.C, to pass an order directing the 2nd Respondent Police Not To Harass the petitioner in the guise of enquiry on the basis of the complaint given by the 3rd Respondent. O RDER This petition is filed seeking direction to the second Respondent Police not to harass the petitioner in the guise of enquiry on the basis of the complaint given by the third Respondent 2.The learned Government Advocate (Crl. Side) would submit that based on the complaint given by the third respondent herein, enquiry was undertaken and summon was issued to the petitioner. On the point of jurisdiction, the complaint was transferred from the Inspector of Police, Thalaivaipuram, to the Inspector of Police, Sethur Police Station, Virudhunagar District. On the basis of the above forwarding complaint, enquiry is undertaken. 3.The learned counsel appearing for the petitioner would submit that before the Thaliavaipuram Police Station, there was an enquiry. That was also closed. 4.The learned Government Advocate (Crl. Side) would submit that it was not closed. But only the enquiry was forwarded to the second respondent/Sethur Police Station on the point of jurisdiction as mentioned above. 2/5

5.Now serious allegations are made against the petitioner that misappropriation of amount, both the parties appeared before the second respondent. Let the above said enquiry be completed by the second respondent within a period of fifteen days from the date of receipt of a copy of this order. If any trouble arises during the course of enquiry, the petitioner can workout his remedy through appropriate proceedings. There is no question of harassment. 6.With the above directions, this criminal original petition is disposed of.
