O R D E R

This Writ Petition has been filed seeking issuance of a Writ of Mandamus directing the second respondent to conduct an enquiry on the petitioner's objection petition dated 23.08.2025 in accordance with the provisions of Section 10 of the Tamil Nadu Survey and Boundaries Act, 1923 and to survey and fix the boundaries of Survey Nos. 43/4A and 43/4B situated at South Thathanaickenpatti Village, Palani Taluk, Dindigul District, strictly in accordance with the title documents of the respective parties.

2. The learned counsel for the petitioner would submit that there are variations between the title deeds and the new FMB sketch with regard to Page No. 2 of 5

the shape of the properties of the petitioner and the fifth respondent; that though the petitioner submitted an objection petition dated 23.08.2025, the same has not been considered and the revenue officials are proceeding to survey the land based on the erroneous FMB sketch; and that the proposed survey is only for record purposes and is not in accordance with the provisions of Section 10 of the Act.

The learned Additional Government Pleader appearing for the first to fourth respondents, on instructions, would submit that only after consideration of the petitioner's objection, steps would be taken to survey and demarcate the lands in question in accordance with Sections 9 and 10 of the Tamil Nadu Land Survey and Boundaries Act, 1923.

4. Recording the aforesaid submissions, this Court directs the second respondent to consider the petitioner's objection petition dated 23.08.2025 and the objections of all interested parties, if any, conduct an enquiry and survey and demarcate the lands in question and pass orders in accordance with Sections 9 and 10 of the Tamil Nadu Survey and Boundaries Act, 1923. In the event of any rival claims, the parties are at liberty to work out their remedies before the competent Civil Court. It is Page No. 3 of 5

made clear that prior to conducting the survey, notice shall be issued to the petitioner, the fifth respondent, the adjacent landowners and other interested parties, if any.

5. With the above directions, this Writ Petition stands disposed of. There shall be no order as to costs. Consequently, the connected Miscellaneous Petitions are closed.
