Prayer in W.P.(MD)No.20563 of 2019:

Writ Petition filed under Article 226 of the Constitution of India praying for the issuance of a writ of Mandamus to direct the 3rd respondent to give water connection to the petitioner's house bearing D.No.4/77-3, Perungudi, Thirumogur, Madurai East Taluk, Madurai District, based on the petitioner's representation dated 15.07.2019 within the time limit.

ORDER

This contempt petition filed to issue contempt notice to the contemnor for his willful disobedience of the order granted by this Court in W.P.(MD)No.20563 of 2019 dated 26.09.2019 and punish him. 2.This Court, in the Writ Petition filed by the petitioner in W.P.(MD)No.20563 of 2019, passed an order on 26.09.2019 in the following lines:

"3.Considering the facts and circumstances, a direction is given to the third respondent to consider the petitioner's representation dated 15.07.2019, requesting to provide water connection to his house bearing Door No.4/77-3, Perungudi, Thirumogur, Madurai East Taluk, Madurai District, and pass orders in accordance with law, within a period of four weeks from the date of receipt of a copy of this order." https://hcservices.ecourts.gov.in/hcservices/

3.Since no water connection was given to the petitioner and no order has been passed after the direction given to the respondent, this Contempt Petition is filed. The learned Additional Government Pleader appearing for the respondent produced before this Court a copy of the proceedings of the President of Thirumogur Panchayat Union, Madurai East Panchayat Union. In the proceedings, the representation of the petitioner has been considered and disposed of by stating that due to scarcity of water no individual connection to the houses can be given and that the petitioner can use the common connection that is given just in front of his house for the time being. It is further stated that in future, if any connection is given to others, the petitioner will also be given preference to others.

This order passed by the President of Thirumogur Panchayat Union is in compliance of the direction of this Court. Recording the compliance, this contempt petition is closed.
