ORDER

Heard the learned counsel for the writ petitioner and the learned Additional Government Pleader for the respondents 1 to 3. Issuance of notice to the respondents 4 and 5 is dispensed with. 2.The case of the petitioner is that Palaniyandi, the father of the respondents 4 and 5 sold the petition mentioned property in his favour way back in the year 1978 vide Document No.637/1978. The grievance of the petitioner is that the very same property is the subject matter of release deed executed by the fourth respondent in favour of the fifth respondent. The petitioner, therefore, wants the second respondent to hold enquiry under Section 68 r/w. 83 of the Registration Act. 3.Section 68 of Registration Act will only confer supervisory jurisdiction on the second respondent at the administrative level. Invoking the said power, the second respondent cannot nullify any 2/4

registration. Section 83 of the Registration Act can be invoked only if a false statement is made in the course of an enquiry by the registering authority. Execution of a document without title will not as such attract Section 83 of the Act. The petitioner prima facie has an excellent case but then he has to go only before the jurisdictional Civil Court. 4.Granting such liberty, this writ petition is disposed of.
