JUDGMENT

Earlier, when the matter was listed on 22.01.2024, learned counsel appearing for the appellant reported "no instructions" and filed a memo, dated 03.01.2024 to that effect. Under those circumstances, the matter was directed to be listed today by printing the name of the appellant in the cause list. In spite of the same, the matter being listed today, under the caption "for dismissal" no representation for the appellant. In the circumstances, this Court is left with no other option except to dismiss this appeal for non-prosecution.
