ORDER
The petitioner seeks a direction to the first respondent to dispose of his appeal petition dated 23.06.2025.
2. Mrs.D.Farjana Ghoushia, learned Special Government Pleader, takes notice for the respondents 1, 3 and 4. Mr.S.Vinoth, learned Government Advocate, takes notice for the second respondent. By consent of parties, this writ petition is taken up for final disposal at the admission stage itself.
3. According to the petitioner, he is a registered contractor of the second respondent Panchayat Union. The second respondent invited tenders for various works, including "Construction of Retaining Wall at Kadaneri Village and Panchayat of Watrap Block under MLA-CDS for the year 2025-26." The petitioner submitted his application for the same. However, the second respondent directed the petitioner to withdraw his bid, stating that the said contract works would be allotted to persons belonging to the local constituency members.
4. Aggrieved, the petitioner filed W.P.(MD) No.15552 of 2023 seeking a direction to the second respondent to consider all online e-tender applications dated 30.05.2025, including his own. The said writ petition was 2/5
dismissed, but liberty was granted to the petitioner to approach the appellate authority. Accordingly, the petitioner preferred an appeal before the first respondent. Since the said appeal has not been disposed of, he has now approached this Court.
5. The learned Special Government Pleader appearing for the respondents 1, 3 and 4 would submit that the appeal of the petitioner will be considered and disposed of in accordance with law.
6. In view of the above, without expressing any opinion on the merits of the matter, the first respondent is directed to dispose of the petitioner's appeal dated 23.06.2025 and pass final orders on its own merits, within a period of four months from the date of receipt of a copy of this order, after issuing notice to the petitioner.
