ORDER : The Court made the following order :- The petitioner, who was arrested on 08.08.2025 and in the judicial custody for the past 25 days, for the offences punishable under Section 417 and 420 of IPC r/w Section 4 of the Tamil Nadu Prohibition of Harassment of Women Act, 2002 in Crime No.32 of 2025, on the file of the respondent police, seeks bail.

2.The case of the prosecution is that the Defacto Complainant has studied up to M.A.B.Ed and she is a Junior Artist in Cini field at Chennai. The De-facto complainant and the Accused who is neighbour are having love affair from the year 2019. In the March month of the year 2020, one Friday at 1.30 P.m, the accused came to her house and having sexual intercourse with her by promising to marry her. Likewise, he had sexual intercourse with the De-facto complainant on many times in many occasion at her house and his house 2/6

by promising to marry her. While this being so, the accused is about to marry one Ayisah. When the De-facto complainant has questioned the same and asked to marry her, the accused refused to marry her. Hence, the complaint.

3.The learned counsel for the petitioner submitted that the petitioner is an innocent and he has been falsely implicated in this case. He would further submit that earlier this Court granted bail and the same was cancelled and he is in jail for the past three days. Hence, he seeks bail.

4.The learned Additional Public Prosecutor submitted that earlier this Court granted bail to the petitioner. Thereafter, based on the allegation, the interim bail granted by this Court was already vacated. Now, the petitioner is in jail for the past three days. However, he 3/6

opposed for grant of bail to the petitioner.

5.Taking into consideration of the facts and circumstances of the case and based on the allegation, this Court already cancelled the interim bail granted to the petitioner.

6.In the result, this Criminal Original Petition is dismissed.
