ORDER

Aggrieved over the non execution of the order made in Crl.O.P(MD)No.4338 of 2023 dated 07.03.2023, this petition has been filed, stating that no proper action has been taken by the respondent to secure the accused Nos.4 and 5 before the trial Court.

2. Learned Government Advocate (Crl.side) submitted that now it has been ascertained that the accused Nos.4 and 5 are residing in abroad and their address particulars are unable to be traced. If the petitioner has any information about them, he can share them to the second respondent herein.

3. Learned counsel for the petitioner submitted that in view of the developments, a direction may be issued to the trial Court to split up the case against the accused Nos.1 and 2 and dispose of the same.

4. Considering the request of the petitioner and also considering the developments, there shall be a direction to the trial Court to split up 2/4

the case against the accused Nos. 1 and 2 and proceed to dispose of the same within a period of four months from the date of receipt of a copy of this order. Necessary steps may be taken to secure accused Nos.4 and 5 as ordered, as expeditiously as possible, by taking all proper steps by approaching the concerned Court.

5. With this direction, this Contempt Petition is closed. 15.11.2023 NCC :
