PRAYER :- For Anticipatory Bail in Crime No.71/2024 on the file of the respondent police. ORDER : The Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offences under Sections 174(3) of CrPC and Section 306 of IPC, in Crime No.71 of 2024 on the file of the respondent police, seeks anticipatory bail.
2. When the matter came up for hearing on 08.11.2024, this Court passed the following order:- "This is the third anticipatory bail petition filed by the petitioner who is the mother in law of the deceased. The learned Counsel appearing for the petitioner has produced the scan report of the deceased Priyadharshini. It is submitted that the husband of the deceased was working in a foreign country for more than two years. However, the deceased got pregnant and the scan record shows that G.A. was 7 weeks and 5 days. Only because of this, the deceased had committed suicide.
2.The learned Government Advocate(Crl.side) seeks for time to get instructions in this regard.
3.Post this case on 15.11.2024."
3. When the matter was taken up for hearing today, the post mortem report was placed before this Court and it shows that the uterus was normal in size and there is no sign of the deceased being pregnant.
4. The learned Government Advocate (Criminal Side), on instructions, submitted that the very scan report that has now been produced before this Court require some investigation and that when the police approached the concerned lab, they were not willing to give the genuineness certificate for this scan report.
5. Considering the above, this Court does not find any change in circumstances
