Prayer : Criminal Original Petition is filed under Section 482 of Cr.P.C., to call for the records of the impugned in Spl.SC.No.57 of 2025 on the file fo the III Additional District Court (PCR), Madurai, dated 06.05.2025 and quash the same as illegal.

ORDER

The petitioners seek to quash the impugned Final Report in Spl.SC.No.57 of 2025 on the file fo the III Additional District Court (PCR), Madurai, dated 06.05.2025, which was filed for the offences under Sections 191(2), 296(b), 115(2), 118(1), 351(3) of BNS, 2023 and Sections 3(1)(r), 3(1)(s), 3(2)(va) of SC/ST (PoA) Act, 1989.

2. The allegation in the Final Report is that the petitioners, on account of prior enmity, had attacked the defacto complainant and another victim with sticks, abused them in filthy language and also humiliated them on account of their caste.

3. Admittedly, the petitioners and the second respondent have now entered into a compromise and decided to give a quietus to the entire dispute. The parties have filed a joint compromise memo dated 8th September 2025 and the scanned copy of the compromise memo reads as follows: 3/10

4. The learned Additional Public Prosecutor, on instructions, would submit that the defacto complainant and the victim have received Rs.62,500/- each as compensation and they are bound to remit the same to the Aadidravidar Welfare Department.

The petitioners, namely, Balaji (Aadhaar No.5066 7747 5960), Sivagnanaprakasam (Aadhaar No.6611 9642 4545), Balu (Aadhaar No.2562 2462 3676), Anandh (Aadhaar No.4340 6996 4065), Vasanth (Aadhaar No. 8734 6620 8030), Nandha Pandiyan (Aadhaar No.3350 0504 4136), Alagu (Aadhaar No.7346 1849 6118), the second respondent, namely, Rajendraprasath (Aadhaar No.4813 1199 7314) and the victim, namely, Manickam (Aadhaar No. 5887 1859 0012) are present before this Court in person and identified by Mr.S.Pitchai, Head Constable, Melur Police Station, Madurai District. The second respondent and the victim confirm the compromise and states that they have no objection for quashing the sessions case.

6. The dispute is private in nature. Considering the nature of the allegations and the compromise arrived at between the parties, this Court is of the view that no useful purpose would be served in keeping the impugned final report pending trial. Accordingly, the impugned final report in Spl.S.C.No.57 of 7/10

2025 on the file of the III Additional District Court (PCR), Madurai, is quashed, on condition that the defacto complainant and the victim shall deposit the compensation amount of Rs.62,500/- each, which was received by them to the Aadidravidar Welfare Department, within a period of six weeks from today, failing which, the order passed by this Court shall lose its efficacy.

7. The petitioners shall pay a additional sum of Rs.10,000/- (Rupees Ten Thousand only) as costs to the High Court Legal Services Authority attached to this Bench forthwith and file a photocopy of the receipt along with a memo reporting compliance in the Registry.

8. In the result, this Criminal Original Petition stands allowed. Consequently, connected Miscellaneous Petition is closed. 24.09.2025 NCC : Yes / No Index : Yes / No Internet : Yes/ No Indu 8/10
