The present Civil Miscellaneous Petitions have been filed 1)to condone the delay of 291 days in filing the petition to set aside the abatement caused due to the death of the 6th respondent in the Civil Revision Petition;

2)to set aside the abatement caused due to the death of the 6th respondent in the Civil Revision Petition; and 3)to bring on record the respondents 8 and 9 as legal heirs of the deceased 6th respondent and rank them as respondents 8 and 9 in the above Civil Revision Petition.

2.Heard Mr.C.Kishore, for the petitioner, Ms.Shiyamala Gowri, for the respondents 2 and 7 and Ms.Epsiba, for the respondents 3, 5 and 9. 3.Ms.Shiyamala Gowri, for the respondents 2 and 7 and Ms.Epsiba, for the respondents 3, 5 and 9 have no objection for allowing these Civil Miscellaneous Petitions.

cmr 4.Being satisfied with the reasons stated in the accompanying affidavit filed in support of these petitions, this Court is inclined to condone the delay of 291 days.

5.Accordingly, these Civil Miscellaneous Petitions are allowed and the delay is condoned. The Registry is directed to carry out necessary amendments.
