Respondents Prayer : This Civil Revision Petition filed under Article 227 of the Constitution of India, to issue appropriate order/orders directing the Subordinate Judge, Thoothukudi to dispose of the A.S.No.91 of 2018 on the file of the Subordinate Judge, Thoothukudi within a reasonable time as may be fixed by this Court.

ORDER

The Civil Revision Petition has been filed seeking a direction to dispose of the suit in A.S.No.91 of 2018, pending on the file of the Subordinate Court, Thoothukudi, within a specified time fixed by this Court.

2. Since the revision petition is filed for early disposal of the case, the issuance of notice to the private respondents is not necessary. 2/4

3. The revision petitioner has filed an appeal in A.S.No.91 of 2018, challenging the judgment and decree passed in O.S.No.47 of 2009 dated 16.12.2010.

4. The learned counsel appearing for the revision petitioner would submit that the appeal suit was numbered on 12.11.2018 and after serving summons to the respondents, they also appeared through their Advocates and thereafter, the appellants's side argument was closed on 22.01.2020. He would further submit that the respondents are intentionally drag on the proceedings and the suit is pending for the past more than five years.

5. Considering the above, the appellate Court is hereby directed to complete the trial in A.S.No.91 of 2018 and dispose of the same within a period of eights months from the date of receipt of copy of this order.

6. With the above direction, this Civil Revision Petition is allowed. No costs.
