ORDER
The present contempt petition has been filed alleging violation of the order of this Court dated 01.08.2025 in W.P.(MD).No.20992 of 2025.
2. The above contempt has been filed on the ground that orders of this Court dated 01.08.2025 in W.P(MD)No.20992 of 2025 has not been complied with.
3. Operative portion of the above referred order reads as follows:- "10. Since the petitioner's father'ss Community Certificate has been accepted by the State Level Scrutiny Committee in their proceedings dated 24.12.2010, there is no scope for re~enquiry into the same again. Relavant portion of the aforesaid proceedings of the State Level Scrutiny Committee, dated 24.12.2010, bearing reference in No.20696/CVIII/2008~12, reads as under:- "5.The State Level Scrutiny Committee have carefully and independently examined the above original records, the oral statement of the individual and the report of the Revenue Divisional Officer, Madurai and the views of the Anthropologist.
After careful examination of the aforesaid documents/records the State Level Scrutiny Committee have unanimously accepted the claim of the individual and hereby confirms that the Hindu 'Kattunayakan' Scheduled Tribe Community Certificate bearing Serial No.624004 dated 10.03.1989 issued by the Tahsildar, Madurai North to Thiru P. Sekar, S/o.Thiru A. Perumal, residing at 15/1, Kattunayakkan Street, Anthanerikanmoi Road, Madurai - 625 107 is a genuine one."

11. Therefore, there is no justification in retaining the Certificates of the petitioner as there is no scope for further re~enquiry into the Community Certificate issued to the petitioner's father. (*)Therefore, there shall be a direction to the respondent to issue the above mentioned Certificates to the petitioner on or before 29.08.2025."

The above referred writ petition had been filed by the petitioner herein only against the contemnor herein and the relief that was claimed by the petitioner was for a direction to the respondents to forthwith release her original certificates which included:- a) 12th standard Mark-sheet b) Community Cerfificate c) Provisional Certificate - I and II d) Degree-cum-Conduct Certificate e) Internship Completion Certificate and f) Academic Record Book
5. The petitioner had furnished certificate stating that she belong to Kattunayakan Community which is shown in the list of Scheduled Tribe. The State Level Scrutiny Committee was asked by order dated 26.11.2019 was called upon by the Revenue Divisional Officer, Madurai to enquire into the genuineness of the community certificate that had been issued by 3/8
the petitioner. This order was challenged by the petitioner in W.P(MD)No. 403 of 2020. The Hon'ble Division Bench has passed an order stating that the respondents cannot conduct an enquiry into the veracity of the petitioner's community certificate but the community certificate of her father could be ascertained. The scrutiny of the father's community certificate was pending then. The petitioner had not sought to implead the revenue in the said writ petition.

A counter is being filed by the respondent wherein they would state that they had been asked by the respondent herein to verify the genuineness of the certificate submitted by the petitioner just as she was completing her course. The Revenue Divisional Officer by his communication dated 01.04.2025 had entertained a doubt with reference to the community certificate issued to the petitioner. Therefore, the District Collector, Madurai had requested the Chief Secretary, Revenue and Disaster Management Department Chennai by his communication dated 19.11.2024 to appoint four or five members of the Anthropologist Committee to go into the genuineness of the certificate issued under Kattunayakan and Malai Vedan Communities.

7. It was in these circumstances that the writ which is now the subject matter of contempt had come to be filed. The respondents would submit that the writ petitioner had not impleaded the necessary parties to the proceedings. The respondents would further submit that he is not the competent authority to verify the genuineness or otherwise of the certificate as scrutiny of all the certificates falls exclusively within the domain of the District Collector/ Anthropologist Committee constituted by the Government.

That apart, it is now brought to the notice of the Court that the petitioner has filed W.P(MD)No.25014 of 2025 calling upon the 1st respondent to issue the genuineness verification order in respect of the petitioner's ST Kattunayakkan Community Certificate on the basis of the genuineness certificate issued to the father.
9. Having filed the above writ petition, the respondents would submit that it is not open to the petitioner to contend that the respondents are in contempt of orders of the Court as the petitioner by filing the above referred writ petition has practically tied the hands of the respondent from 5/8
conducting the enquiry and issuing the certificate. In fact the Hon'ble Division Bench in their interim order has impliedly directed the Revenue Department to verify the certificate in question. In the said interim order, the Hon'ble Division Bench observed as follows:- "12. In the meanwhile, the petitioner is permitted to go to the Madurai Medical College as and when she is called to attend the counselling session and certificate verification. The certificates shall be given to her temporarily, to enable her to upload her registration for the counselling session within the college premises itself, upon completion of which, the certificates shall be handed back to R4. R4 shall ensure that the certificates are made available to her at the time of the counselling session and the certificate verification process, and shall retain the same/transfer the same back to the Medical College, post the verification process."
10. Therefore, till the conclusion of this enquiry, the relief granted in W.P(MD)No.20992 of 2025 has to necessarily be kept in abeyance. Therefore, the contempt petition stands dismissed. 18.09.2025 NCC :yes/No Index :yes/No Internet:yes/No 6/8
