Heard Mr.B.Brijesh Kishore, learned counsel for the petitioner, Mr.P.Sundaravadivel, learned Standing Counsel for the first respondent and Mr.K.Gnanasekaran, learned Government Advocate (Criminal Side), for the second respondent.
2. This Writ Petition has been filed praying for a Mandamus, directing the first respondent to issue passport to the petitioner on the basis of petitioner's explanation made before the first respondent herein by RPAD dated 22.10.2024, in response to the notice issued by the first respondent dated 16.10.2024.
3. The petitioner had made an application seeking for issuance of passport in which he had not intimated the pendency of criminal case registered in Crime No.297 of 2024 for the offences punishable under 2/4
Sections 189(2), 126(2), 292, 285 BNS. Hence, a notice was issued to the petitioner on 16.10.2024 calling upon him to visit the office along with case related and all original documents and submit a suitable explanation within 30 days. Pursuant to the said notice, the petitioner had also submitted his explanation on 22.10.2024 and he had also enclosed the acknowledgment card indicating the proof of service.
4. In such view of the matter, I am inclined to direct the first respondent to consider the petitioner's application for grant of passport based upon the explanation submitted by the petitioner dated 22.10.2024 and pass orders, within a period of four weeks from the date of receipt of a copy of this order.
5. With the above direction, this Writ Petition is disposed of. No costs.
