Civil Miscellaneous Petition filed praying that in the circumstances stated therein and in the affidavit filed therewith the High Court may be pleased to extend the stay already granted in CMP(MD) No.1216/2023 dated 28.03.2023. Prayer in CMP(MD). 1216/ 2023 :

To stay the Fair R.C.A.No.14/2018 on the file of the Rent Control Appellate Authority(Principal Sub Judge), Thirunelvlei, confirming the fair and executable order dated 12-09-2018 made in in RCOP.No.12/2016 on the file of the Rent Contoller (1st Additional District Munsif), Tirunelveli pending disposal fo the CRP. Prayer in CRP(MD). 262/ 2023 :

Under Section 25 of the Tamil Nadu Building(Lease and Rent Control) Act,to set aside the Fair order and Executable order dated 07-01-2022, made in R.C.A.No.14/2018 on the file of the Rent Control Appellate Authority (Principal Subordiante Court) Tirunelveli, by confirming the Fair and Executable Order dated 12-09-2018 made in RCOP.No.12/2016 on the file of the 1st Additional Rent Controller (1st Additiona District Munsif Court), Tirunelveli and allow the Revision. ORDER : This Civil Miscellaneous Petition coming up for orders on this day, upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of MR.R. SURIYA NARAYANAN, Advocate for the petitioner and of MR.G.PRABHU RAJADURAI, Advocate on behalf of the Respondents 1 & 2 and of MR.T.BALAJI, Advocate for the 2nd Respondent, the court made the following order:- The petition has been filed by the petitioner for extension of stay granted in C.M.P.(MD)No.1216 of 2023 on 28.03.2023.

2.According to the petitioner, he filed C.R.P.(MD)No.262 of 2023 against the fair and executable order dated 07.11.2022 made in R.C.A.No.14 of 2018 on the file of the Rent Control Appellate Authority (Principal Subordinate Court), Tirunelveli, confirming the fair and executable order dated 12.09.2018 made in R.C.O.P.No.12 of 4/6

2016 on the file of the I Additional Rent Controller (I Additional District Munsif Court), Tirunelveli. This Court was pleased to issue notice to the parties and post the Civil Revision Petition after two weeks and also granted interim stay. Now the first respondent filed an execution petition in E.P.No.10 of 2023 on the file of the Principal District Munsif and the same is posted for production of copy of stay order. Hence, he filed the present petition.

3.Considering the facts and circumstances of the case and also considering that this Court has already granted interim stay, it is appropriate to grant extension the stay for further period of four weeks (i.e. till 27.11.2023). 4.Post the matter on 27.11.2023.
