Order : This Criminal Miscellaneous Petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of Mr.K.ARUNRAJ, Advocate for the petitioner and of Mr.R.SURESH KUMAR, Government Advocate(Crl.side) on behalf of the Respondent, the Court made the following order:- 1/4
This criminal miscellaneous petition has been filed to modify the condition imposed by this Court in Crl.O.P.(MD)No.16913 of 2023 dated 20.09.2023. 2.The learned counsel appearing for the petitioner would submit that the petitioner is an accused in Cr.No.253 of 2023, which was registered for the offence under Sections 147, 148, 341, 294(b), 324 and 506(ii) IPC r/w Section 3 of TNPPDL Act. The allegations as against the accused is that they damaged the school bus, wort about Rs.20,000/-. Therefore, while granting anticipatory bail, this Court directed the petitioner to deposit a sum of Rs.1,00,000/- to the credit of Crime No.253 of 2023 before the trial Court without prejudice to his rights and contentions before the trial Court. He would further submit that the co-accused moved anticipatory bail before the Court below and the Court below granted anticipatory bail on condition to deposit a sum of Rs.5,000/- each and as of now, Rs.45,000/- was deposited. He also produced the receipts. Therefore, he would pray for modification of the above said condition.
3.The learned Government Advocate(Crl.side) appearing for the respondent police would submit that the co-accused deposited Rs.5,000/- each to the credit of Crime number.

4.Considering the above submissions and considering the fact that the value of damaged articles is Rs.20,000/- and so far the co-accused deposited Rs.5,000/- each (Totally Rs.45,000/-), this Court is inclined to modify the condition. Accordingly, the petitioner shall deposit a sum of Rs.5,000/- (Rupees Five Thousand only) to the credit of Cr.No.253 of 2023 before the trial Court concerned, within a period of two weeks from the date of receipt of a copy of this order, without prejudice to his rights and contentions before the trial Court. 5.In the result, this criminal miscellaneous petition is allowed. sd/- 08/12/2023 / TRUE COPY / /12/2023 Sub-Assistant Registrar (C.S. ) Madurai Bench of Madras High Court, Madurai - 625 023.
