ORDER
This Criminal Original Petition has been filed to transfer the investigation pertaining to the case registered in Cr.No.23 of 2023 pending on the file of third respondent to the fourth respondent .
2. According to the petitioner he is working in Singapore as a Labour. The mother of the petitioner namely Amuthavalli was living with his family. While so, On 13.09.2023 when the petitioner was at Singapore he received information that his mother died. Thereafter he arrived at his native place and saw the dead body of his mother in the Government Hospital, Ramanathapuram on 14.09.2023. The third respondent registered a case in Crime No.23 of 2023 for the offence under Section 174 of Cr.P.C., on the complaint given by the Village Administrative Officer that the dead body of the mother of the petitioner was found in the railway track near to Theeyanur Village. The petitioner initially believed that the third respondent would conduct fair investigation and find out the cause of the death, however they have not find out the cause for the death. The third respondent without investigating the case properly is taking steps to 2/7
close the case by assigning false reasons. The death of the mother of the petitioner is neither accident nor a suicide and it is a case of murder. The mother of the petitioner used to wear gold nose stud and gold chain at any time and when the petitioner saw the dead body of his mother there was no nose stud and chain, thereby it is clear that some other persons have committed robbery and murdered the mother of the petitioner. After the death of his mother 45 sovereigns of gold jewels were found missing in the house of the petitioner, therefore the respondent police have not investigated the case properly, thereby he has sent a representation dated 27.09.2023 and the same has not been considered, hence filed this petition to transfer the investigation

The learned Government Advocate appearing for the State would submit that based on the complaint lodged by the VAO concerned a case has been initially registered by the third respondent in Crime No.23 of 2023 under Section 174 of Cr.PC. Thereafter the case has been transferred to the fifth respondent herein and the fifth respondent reassigned First Information Report in new Crime No.07 of 2024 and thereafter the investigation officer went to the place of occurrence prepared observation mahazhar, rough sketch and also examined other 3/7
witnesses. They also examined the close relatives of the deceased and from their statement it is revealed that the daughter of the deceased Sinagara Vasuki died in the year 2016 and after marriage her son was brought up by the mother of the petitioner and 40 sovereigns of gold jewels which were given as sreedhana have been returned to her and thereafter she was doing money lending business . The petitioner got love marriage as against the Will of the deceased and thereafter she was residing separately and she appointed one Selvi as Accountant for the money lending business. The doctor who conducted post mortem also stated reasons that death is due to the hit of heavy vehicle, therefore there is no evidence to show that somebody committed murder of the deceased. The deceased while crossing the railway track might have met the accident and thereby they closed the complaint and hence the present petition is liable to be dismissed.
4. Heard both sides and perused the materials available on record.
5. On perusal of the records, it is seen that the mother of the petitioner died in a suspicious manner near the railway track. Initially a case has been registered by the railway police /third respondent in Crime 4/7
No.23 of 2023 for the offence under Section 174 of Cr.PC., and thereafter the case was transferred to the fifth respondent and a case has been registered in Crime No.7 of 2024 and after investigation was found that there is no evidence to suspect the death of the mother of the petitioner and there are no materials found for commission of murder of the deceased. The investigation shows that the deceased might have been died due to hit of heavy vehicle, since the body was found near railway track it shows that one train might have been dashed against the deceased and thereby no evidence for murder. Since already investigation was completed and there is no specific and personal allegations as against the investigation officer and the alleged occurrence took place on 13.09.2023 and now after three years it is not appropriate to transfer the investigation and the petition has no merits and deserves to be dismissed.
