.. Respondents Prayer: Petition filed under Section 11 of the Contempt of Courts Act, to punish the contemnors/respondents for their deliberate and willful disobedience of the order of this Court, dated 29.04.2024 in W.P.(MD) No.10603 of 2024.

ORDER

This contempt case has been filed complaining willful disobedience of the order dated 29.04.2024 in W.P.(MD)No.10603 of 2024.

2. While disposing the said writ petition, this Court directed the first respondent therein to release the grant so as to enable the third respondent therein to disburse the same to the petitioner towards entire terminal benefits payable to the petitioner.

3. The learned counsel for the second respondent submits that the petitioner is entitled for Rs.72,43,317/- towards his terminal benefits after attaining the age of superannuation. Before filing this contempt petition, Rs.57,53,421/- was paid to the petitioner. After granting funds by the first respondent, on 28.02.2025, the amount of Rs.14,89,896/- was

paid to the petitioner. By this payment, the second respondent has paid the entire terminal benefits payable to him.

4. The learned counsel appearing for the first respondent would submit that on 21.02.2025, they released the grant to the second respondent to disburse the same to the petitioner.

5. On considering the facts and circumstances of the case, it appears that the second respondent has paid the entire amount of Rs.72,43,317/- to the petitioner as on date. If the petitioner has any grievance about the quantum of the payment received, it is open to the petitioner to ventilate his grievance before the appropriate forum.

6. This Court is placing its displeasure to the action of the first respondent in not releasing the grant to the second respondent within a time stipulated by this Court. The first respondent is hereby warned. If such delay is occurred in implementing the order of this Court, serious note will be taken against the first respondent.
