PRAYER: Criminal Original Petition filed under Section 482 Cr.P.C. praying to direct the second respondent not to harass the petitioner under the guise of enquiry.

ORDER

This petition has been filed seeking direction to direct the second respondent not to harass the petitioner under the guise of enquiry.

2. Today, when the matter is taken up for hearing the learned Additional Public Prosecutor appearing for the respondent police submits that on the complaint given by one Venkatesh a case in Crime No. 504 of 2019 was registered by the respondent police for the offences under Sections 457 and 380 of IPC. Thereafter the petitioner voluntarily surrendered before the learned Judicial Magistrate No.II, Madurai on 17.06.2019. The second respondent took him to custody and he also confessed that he committed the offence along with another person and based on the confession given by them the respondents are yet to recover the jewels stolen by the petitioners. Subsequently the petitioner was released on bail without any condition. The respondent police have summoned the petitioner only to recover the stolen jewels which were in their possession, but the petitioner is evading to appear before the respondent. Further the respondent police is not harassing the petitioner.

3. Recording the same, this Criminal Original Petition is closed.
