Prayer : Criminal Original Petition is filed under Section 528 of BNSS, 2023/482 Cr.P.C, To direct the 1st Respondent to withdraw and transfer the cases in Crime No.13/2023 on the file of 6th Respondent police, DCB Sivagangai and entrust the same to the other investigation officer not below the rank of DSP in CBCID .

ORDER

The petitioner has sought for transfer of investigation mainly alleging that though the F.I.R was registered in the year 2023, the respondents have not file final report, even now.

2. Per contra, the learned Additional Public Prosecutor, on instructions, would submit that the final report could not be filed, since two accused were 2/4

absconding and that the respondents would take effective steps to secure the accused and file final report.

He would further submit that the investigation in all other aspects are completed and they will file final report within two months.

3. In such circumstances, the learned counsel for the petitioner would submit that he is not pressing for the transfer of the case.

4.
