ORDER

Heard both sides.

2.The writ petitioner and the fourth respondent are siblings. Their father / Periyasamy was granted crackers license to sell crackers during diwali season. The father passed away in the year 2014. The petitioner was granted license. It is being renewed every year. Dispute arose between the brothers. The fourth respondent filed O.S.No.106 of 2023 on the file of the District Munsif Court, Papanasam. Vide order dated 24.10.2024 in I.A.No.279 of 2023, an interim arrangement was made for last year. As per the said order, an advocate commissioner was appointed and he was to be paid remuneration to the tune of Rs.7,500/-. The advocate commissioner was to inspect the accounts and submit his report and the fourth respondent herein was to be paid 10% of the profit earned by the writ petitioner.

3.The petitioner through his counsel gives an undertaking that he will scrupulously maintain the accounts and the same can be inspected by the fourth respondent. The petitioner also offers to share 15% of profits with the fourth respondent. Since no advocate commissioner is being appointed, the petitioner need not pay remuneration for any advocate commissioner. That is why, I thought it fit to enhance the share of the fourth respondent from 10% to 15%. This arrangement has been evolved only for the current year.

4.Recording the aforesaid undertaking of the writ petitioner, I direct the second respondent to renew the petition mentioned crackers license for one more year.

5.The learned trial Judge is directed to dispose of O.S.No.106 of 2023 on merits and in accordance with law within a period of eight months from the date of receipt of a copy of this order. 3/6

6.This writ petition is allowed accordingly. No costs. 12.09.2025 NCC : Yes/No Index : Yes / No Internet : Yes/ No ias Issue order copy on 15.09.2025.
