ORDER : This Court made the following order :- The petitioner, who was arrested and remanded to judicial custody on 09.08.2025 for the offences punishable under Section 3 of TNPPDL Act, 1992 and 109,115(2), 132 and 296(b) of BNS Act on the file of the respondent police, in Crime No.249 of 2025 seeks bail.

The case of the prosecution is that the petitioner threatened the police, when he was asked by the respondent police while he was parked his lorry bearing registration No. TN 59G 1722 Bolero in suspicious manner parked his lorry near Rajakoor Village, Othakadai, Idaiyapatti at 10.00 pm. On seeing the police, one of them let the scene of occurrence, when the defacto-complainant and the DSP enquired the petitioner, he abused them in filthy language. When the defactocomplainant inspected the lorry, he pushed them and when he was asked to leave the place, he took reverse the vehicle and hit the defacto-complainant and DSP. It is an attempt to murder, not only that lorry dashed Bolero car and indicator light, pumper back side door, all were totally damaged. The value of the damage estimated at Rs.50,000/-. Hence, the complaint.
3. The learned counsel for the petitioner submitted that the petitioner is an 2/6
innocent person and he has falsely implicated by the respondent police with some ill motive and it is a put case filed by the respondent police. There is no previous case against the petitioner. He would further submit that the petitioner is in custody from 09.08.2025. Hence, he seeks bail.

5.Taking into consideration of the facts and circumstances of the case and there 3/6
is no previous case pending against the petitioner, this Court is inclined to grant bail to the petitioner, subject to the following conditions:- 6.Accordingly, the petitioner is ordered to be released on bail on executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties, for a like sum to the satisfaction of the learned Judicial Magistrate Court, Melur, and on further conditions that :- [a] the sureties shall affix their photographs and Left Thumb Impression in the surety bond and the Magistrate may obtain a copy of their Aadhar card or Bank pass Book to ensure their identity. [b] The petitioner shall furnish her residential address and mobile number to the learned Judicial Magistrate Court, Melur. [c] If the petitioner changes her residential address, he shall report the same to the learned Judicial Magistrate Court, Melur. [d] the petitioner shall report before the respondent police daily at 10.30 a.m., until further orders.
[e] the petitioner shall not abscond either during investigation or trial.
[f] the petitioner shall not tamper with evidence or witness either during investigation or trial.
[g] On breach of any of the aforesaid conditions, the learned Magistrate/Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions have been 4/6
imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560]. [h] If the accused thereafter absconds, a fresh FIR can be registered under Section 269 BNS.
