DECREE: This Civil Miscellaneous Appeal coming on for hearing on this day upon perusing the grounds of Appeal, the order of the Lower Court, and the material papers relating to this case and upon hearing the arguments of Mrs.K.R.Shivashankari, for Mr.S.Srinivasaraghavan, Advocate for the Appellant and of Mr.K.Suresh, for Mr.E.K.Kumaresan, Advocate for the first respondent and of Mr.J.S.Murali, Advocate for the fourth respondent and the second respondent and third respondent are not appearing either in person or by an advocate and the entire award amount has already been deposited by the Insurance Company and this Court, while https://hcservices.ecourts.gov.in/hcservices/ dismissing this Appeal, doth order and decree as follows:-
i) that the Judgment and Decree passed in M.C.O.P.No.436 of 2009, dated 21.03.2012 on the file of the Motor Accident Claims Tribunal, (District Court), Karur be and hereby are confirmed and the Appeal is dismissed;
ii) That the entire award has already been deposited, the Tribunal herein be and hereby is directed to transfer the same with accured interest and proportionate costs to the personal savings Bank Accoutn of the claimant/R1 in CMA(MD)No.1450 of 2013 through RTGS/NEFT system after getting the Account Details from the claimant by the officials of the appellant-Insurance Company, within a period of six weeks (6) from the date of receipt of a copy of this order; and iii) That there be no costs, in this appeal.
