ORDER : The Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offences under Sections 465, 468 and 420 of IPC, in Crime No.12 of 2024 on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that the mother of the petitioner had already dealt with the property and sold by means of sale deeds that were executed from the

year 1996 onwards. After having sold the property, the mother of the petitioner executed the settlement deed in favour of the petitioner dated 24.12.2012. The defacto complainant had purchased this property in the year 2016. According to the defacto complainant, the petitioner was claiming right and title over the property which has already been sold by her mother and therefore was attempting to cheat the defacto complainant.

3. Heard the learned counsel on either side and perused the materials placed on record.

4. Taking into consideration the facts and circumstances of the case and the materials placed before this Court, it is seen that the entire case is borne out by documents. Therefore, there shall be a direction to the respondent police to resort to the procedure under Section 35 of BNSS by calling the petitioner for an enquiry by issuing summons. The petitioner shall attend the enquiry and her statement shall be recorded and the relevant documents shall also be received. The investigation shall be completed as expeditiously as possible.
