ORDER
This Petition is filed to direct the respondents to include the name of the petitioner as Assistant Conservator of Forest in the panel of Foresters fit for promotion as Assistant Conservator of Forest for the year 2017-2018 in terms of section 7(1) r/w Schedule XI-Part-A Clause II
(12) of the Tamil Nadu Government Servants (conditions of Service) Act, 2016 along with all the attendant benefits within the period as may be directed by this Court and subsequently include his name in the panel fit for promotion to the post of Deputy Conservator of Forests for the year 2024-25.
2. Heard the learned counsel on either side and perused the material available on record.

Considering the fact that the petitioner, who had been denied promotion, to which he was entitled to be promoted by including his name in the panel in the year 2017-2018 on the ground of having been imposed with the punishment which had been set aside by the learned Single Judge of this Court in WP(MD)No.2127 of 2019 and affirmed by the Hon'ble Division Bench of this Court in WA(MD)No.1846 of 2023 by dismissal of the intra-court appeal filed by the Government, this Court is of the view that the petitioner is entitled to the relief as prayed for.

In such view of the matter, the respondents are directed to place the petitioner in appropriate place in the panel of Assistant Conservator for Forest fit for promotion to the post of Deputy Conservator for Forest for the panel 2017-2018 and grant him promotion by placing him immediately above his junior and grant him all monetary benefits by taking into consideration the date of appointment of his immediate junior and pass appropriate orders within a period of eight weeks from the date of receipt of a copy of this order. It is made clear that, for the purpose of calculating the petitioner's pensionary benefits, his promotion shall be 3/5
reckoned from that date and his salary shall also be fixed and paid from the said date.
5. With the above observation, this Writ Petition stands disposed of. No order as to costs. Consequently, connected Miscellaneous Petition is closed.
